Farmers filed suit alleging injury to their water rights after the Nevada State Engineer and the California State Water Resources Control Board approved change applications for a voluntary water rights leasing program managed by the National Fish and Wildlife Foundation in the Walker River Basin. The Ninth Circuit principally held that the Decree court failed to defer to the findings and conclusions of the state agencies and, to the extent the Decree court entered its own findings, those findings were clear error. In this case, the Engineer properly found that a transfer to the Foundation limited to the consumption portion would avoid conflict and injury to other existing water rights, the findings were supported by substantial evidence, and the Engineer applied the correct legal rule. The panel also held that the export restriction of the Walker River Decree did not prohibit delivering water to Walker Lake because Walker Lake was part of the Walker River Basin. In this real-property-valuation case, the Supreme Court vacated the decision of the Board of Tax Appeals (BTA) finding that the appraisal report presented by the Washington County Board of Revision and Washington County auditor (collectively, the County) constituted the most competent and probative evidence of the value of the subject property for tax year 2013.The BTA relied on the County’s report to value a property owned by Lowe’s Home Centers, Inc./Lowe’s Home Centers, LLC (collectively, Lowe’s), even though Lowe’s presented its own appraisal report. The Supreme Court vacated the BTA’s decision, holding (1) the Court’s decisions in Steak ’N Shake, Inc. v. Warrant County Board of Revision, 48 N.E.3d 535 (Ohio 2015), Rite Aid of Ohio, Inc. v. Washington County Board of Revision, 54 N.E.3d 1177 (Ohio 2016), and Lowe’s Home Centers, Inc. v. Washington County Board of Revision, 49 N.E.3d 1266 (Ohio 2016), provide the proper guideposts for resolving this controversy; and (2) because the BTA had yet to evaluate the evidence in light of the legal standards articulated in these three decisions, the case must be remanded for further proceedings. The Upper Skagit Indian Tribe purchased land and commissioned a boundary survey, which convinced the Tribe that about an acre of its land lay on the other side of a boundary fence between its land and land owned by the Lundgrens. The Lundgrens filed a quiet title action in Washington state court, arguing adverse possession and mutual acquiescence. The Washington Supreme Court rejected the Tribe’s sovereign immunity claim, reasoning that tribal sovereign immunity does not apply to in rem suits. The U.S. Supreme Court vacated and remanded. The precedent on which the state court relied (Yakima) addressed not the scope of tribal sovereign immunity, but a question of statutory interpretation of the Indian General Allotment Act of 1887. The Act authorized the President to allot parcels of reservation land to individual tribal members and directed the government to issue fee patents to the allottees. In 1934, Congress reversed course but did not withdraw the lands already conveyed so that Indian reservations sometimes contain both trust land held by the government and fee-patented land held by private parties. The Supreme Court held that the state collection of property taxes on fee-patented land within reservations was allowed under the Act; Yakima resolved nothing about the law of sovereign immunity. The North Dakota Department of Transportation ("the DOT") took Rosie Glow, LLC's property through an eminent domain quick-take action. The DOT deposited $2,296,000.00 for the land and $940,860.00 for severance damages. Rosie Glow and the DOT disputed the value of the property taken. Rosie Glow's appraiser estimated the total compensation owed to Rosie Glow was $4,899,000.00, consisting of $3,788,400.00 for the land and $1,110,600.00 for severance damages. The jury awarded Rosie Glow $2,296,000.00 for property taken and $1,240,860.00 in severance damages, totaling $300,000.00 more than the DOT deposited. Rosie Glow appealed the district court's award of $32,400.00 in attorney fees and expert fees and litigation costs of $11,236.41. The North Dakota Supreme Court affirmed the district court's judgment in part, reversed in part, and remanded for further proceedings. The Supreme Court determined the district court did not abuse its discretion in reducing the costs awarded for an appraisal because it adequately explained its reasoning. However, the Court found the district court abused its discretion in declining to award any costs for the appraiser's review of the DOT's appraisal because it did not explain its decision. M.A.K. Investment Group, LLC owned several parcels of property in Glendale, Colorado. The City adopted a resolution declaring several of M.A.K.’s parcels “blighted” under state law. Glendale never notified M.A.K. of its resolution or the legal consequences flowing from it. The blight resolution began a seven-year window in which the City could begin condemnation proceedings against M.A.K.’s property. It also started the clock on a thirty-day window in which M.A.K. had a right to seek judicial review of the blight resolution under state law. Receiving no notice, M.A.K. did not timely seek review. M.A.K. argued Colorado’s Urban Renewal statute, both on its face and as-applied to M.A.K., violated due process because it did not require municipalities to notify property owners about a blight determination, or the thirty days owners had to seek review. The Tenth Circuit concluded the statute was unconstitutional as applied to M.A.K. because M.A.K. did not receive notice that Glendale found its property blighted. Because of this, the Court did not decide whether the statute was unconstitutional on its face. As for M.A.K.’s second argument, the Court held due process did not require Glendale to inform M.A.K. about the thirty-day review window. View "M.A.K. Investment Group v. The Supreme Court affirmed the order of the Tax Equalization and Review Commission (TERC) affirming the valuations of certain grassland properties owned by the Betty L. Green Living Trust and the Richard R. Green Living Trust (the Trusts) that had been established by the county assessor and approved by the county board of equalization (the Board).In its decision, TERC concluded that the Trusts did not present competent evidence to rebut the presumption that the Board faithfully performed its duties and had sufficient competent evidence to make its determinations. The Supreme Court affirmed TERC’s order, holding that TERC’s decision conformed to the law, was supported by competent evidence, and was neither arbitrary, capricious, nor unreasonable. The classification of real property for tax purposes is based on the actual use of the property, and an injunction prohibiting agricultural use of a residentially-zoned property, which is based on a restrictive covenant, does not control the property’s tax assessment classification. However, the record before the Board in this case contained no evidence that the property was used agriculturally within the meaning of Wisconsin tax law.Donald Thoma and Polk Properties LLC (collectively, Thoma) challenged the Village of Slinger’s 2014 property tax assessment for land Thoma attempted to develop into a residential subdivision. The property previously operated as a farm and received an agricultural classification for tax assessment purposes. Thoma and the Village later entered into an agreement that contained a restrictive covenant prohibiting Thoma from using the land for agriculture. The Village then obtained an injunction prohibiting any agricultural use on the property. The Board voted to uphold the assessor’s assessment, which the assessor reached by changing the use classification from agricultural to residential. The circuit court affirmed. The Supreme Court affirmed, holding (1) the Board’s decision upholding the tax assessment was lawful and supported by a reasonable view of the evidence; and (2) the circuit court did not err in denying Thoma’s request to vacate the original order. Petitioner N. Miles Cook, III, appealed a Wetlands Council (Council) ruling upholding the decision of the New Hampshire Department of Environmental Services (DES) denying his request for a permit to reconstruct and extend his dock on the Piscataqua River. Because DES did not have the benefit of the New Hampshire Supreme Court’s interpretation of the term “need” as used in Env-Wt 302.01(a) and Env-Wt 302.04(a)(1) for determining whether an applicant has met the permit requirements, and because, as the Council noted, the central issue was whether petitioner “could justify the expanded dock proposal based on his ‘need’ to access navigable water on a more frequent basis than he currently experiences with the existing dock,” the Supreme Court vacated DES’s decision and remanded to the Council with instructions to remand to DES for further consideration in light of the definition the Court adopted for the purposes of this opinion.
