The pro-forma provision in the tariff in this case, which set the rates and terms for a utility’s relationship with its retail customers, did not conflict with a prior franchise agreement, which reflected the common law rule requiring utilities to pay public right-of-way relocation costs, or the common law, and the franchise agreement controlled as to the relocation costs at issue.At issue was whether the City of Richardson or Oncor Electric Delivery Company must pay relocation costs to accommodate changes to public rights-of-way. The City negotiated a franchise agreement with Oncor requiring Oncor to bear the costs of relocating its equipment and facilities to accommodate changes to public rights-of-way, but Oncor refused to pay such costs. While the relocation dispute was pending, Oncor filed a case with the Public Utility Commission (PUC) seeking to alter its rates. The case was settled, and the resulting rate change was filed as a tariff with the PUC. The City enacted an ordinance consistent with the tariff, which included the pro-forma provision at issue. The Supreme Court held that the provision in the tariff did not conflict with the franchise contract’s requirement that Oncor pay the right-of-way relocation costs at issue. The Supreme Court reversed the order of the Tax Equalization and Review Commission (TERC) affirming the decision of the Custer County Assessor regarding the 2012 taxable value of Donald V. Cain, Jr.’s agricultural property. On appeal, Cain argued, among other things, that the TERC violated his due process rights by not permitting him to argue how the preponderance of the evidence standard of proof applied to the adduced evidence. The court held (1) Cain waived the due process rights applicable in Liljestrand v. Dell Enterprises, 842 N.W.2d 575 (2014); and (2) TERC erred in affirming the Assessor’s valuations of Cain’s property for the 2012 tax year. View "Cain v. The Supreme Court denied the petition for a writ of mandamus filed by a group of landowners (“Landowners”) seeking an order compelling the Ohio Department of Natural Resources’ Division of Oil and Gas Resources Management (“the Division”) and its chief to commence appropriation proceedings to compensate Landowners for their land that was included in an oil and gas drilling unit. Landowners objected an an order issued by the chief requiring that a reservoir of oil and gas underlying multiple tracts of land be operated as a unit to recover the oil and gas, arguing that the order amounted to a taking of their property for which they must be compensated. The Supreme Court denied Landowners’ petition for a writ of mandamus, holding that Landowners had an adequate remedy by way of appeal to the county court of common pleas. View "State ex rel. Kerns v. The Supreme Court reversed the decision of the Board of Tax Appeals (BTA) affirming the decision of the Cuyahoga County Board of Revision (BOR) dismissing the complaint filed by Life Path Partners, Ltd. seeking to challenge the valuation of its property for tax year 2012 under the continuing complaint provision in Ohio Rev. Code 5715.19(D), which provides an exception to the requirement that a taxpayer protesting the valuation of property must file a complaint by march 31 of the year succeeding the tax year in question. The BOR dismissed the case because Life Path had not asked it to exercise its continuing-complaint jurisdiction prior to the deadline that would have applied if Life Path had filed a new complaint challenging the 2012 valuation. The Supreme Court reversed the BTA’s decision affirming the BOR’s dismissal, holding that Life Path properly invoked the BOR’s continuing- complaint jurisdiction pursuant to section 5715.19(D). The issue this case presented for the Georgia Supreme Court’s review centered on the proper statutory interpretation of the Recreational Property Act, OCGA 51-3-20 et seq. (RPA), which shields from potential liability landowners who “either directly or indirectly invite[] or permit[] without charge any person to use the[ir] property for recreational purposes.” Willie and Kristy Harris, along with their six-year-old daughter, Riley, attended a youth football game in 2012 at the Garden City Stadium, a facility owned and maintained by the City of Garden City. Willie and Kristy each paid the required $2 admission fee for spectators over the age of six. However, because Riley was only six years old, the Harrises were not required to pay an entrance fee for her, and Riley was admitted to the event free of charge. At one point during the game, while Riley was walking across the bleachers to return to her seat after visiting the concession stand, she slipped and fell between the bench seats and suffered serious injuries after falling to the ground nearly thirty feet below. The Harrises sued the City to recover for Riley’s injuries, and the City moved for summary judgment, relying on the immunity provided by the RPA. The Supreme Court granted certiorari in this case to determine whether the Court of Appeals erred in concluding that a landowner would not be shielded from potential liability by the RPA where that landowner charged a fee to some people who used the landowner’s property for recreational purposes, but did not charge any fee to the injured party who used the property for such purposes. The Court determined that because the plain language of the RPA shielded a landowner from potential liability under the circumstances presented here, the Court of Appeals erred in concluding otherwise. At issue was the Meade County Board of County Commissioners’ order approving incorporation of a proposed municipality of Buffalo Chip City and setting an election for voters to decide whether to assent to incorporation.After denying a request to stay the election, the election was held, and a majority of voters chose to incorporate Buffalo Chip City. The Board then declared Buffalo Chip City formally incorporated. The circuit court heard Appellees’ appeal and issued a judgment declaring that the Board’s order was invalid, that the election was a nullity, and that Buffalo Chip City was void. The Supreme Court reversed and vacated the circuit court’s judgment, holding that S.D. Codified Laws 9-3-20 requires that any action challenging Buffalo Chip City’s incorporation be brought by the State, and because Appellees did not bring their suit on behalf of the State, the circuit court lacked subject-matter jurisdiction. Michele Brandt, as Trustee of the Michele L. Brandt Revocable Trust, appealed an order dismissing her appeal of the City of Fargo's resolution of necessity. Karen Wieland appealed a judgment dismissing her appeal to the district court from the City's resolution of necessity. In December 2016, the Fargo City Commission passed a resolution of necessity for property owned by Brandt related to construction of a flood protection project. Days later in a separate proceeding, the City passed a similar resolution of necessity for property owned by Wieland. Each resolution authorized the City to proceed with all legal means to obtain the property, including eminent domain. In each case the City filed a record on appeal in the district court and moved the court to dismiss the appeal. In Brandt's appeal, the City moved alternatively to consolidate Brandt's appeal with an eminent domain proceeding that the City also commenced in December 2016. In both appeals, Brandt and Wieland moved the district court to strike all materials from the record that had not specifically been placed in front of the city commission during the respective December 2016 meetings. After a February 22, 2017 hearing in Brandt's appeal, the district court entered an order granting the City's motion to dismiss and holding a resolution of necessity as a predicate to eminent domain is not subject to appellate review by the court. The court also held the City had not acted in bad faith, with a gross abuse of discretion, or fraudulently in passing the resolution of necessity. The order denied Brandt's motion to strike, concluding further consideration of the motion was moot. After a March 21, 2017 hearing in Wieland's appeal before a different judge, the district court entered an order and judgment dismissing Wieland's appeal. The court explained that the decision to go forward with an eminent domain proceeding is the City's political or legislative decision which the court could not review by appeal from issuance of the resolution. The City commenced an eminent domain proceeding for the Wieland property in April 2017. Because of similar dispositions, the North Dakota Supreme Court addressed both appeals in this decision and affirmed, concluding the court in each case did not err in dismissing the appeals because no statutory basis authorized an appeal to the district court from the City's resolutions of necessity. The DC Circuit affirmed the district court's grant of summary judgment to the Department in an action challenging the Department's decision to take a tract of land into trust for the North Fork Rancheria of Mono Indians and authorized it to operate a casino there. The court held that the North Fork was an Indian tribe for which the Department had authority to acquire trust land under the Indian Reorganization Act (IRA). The court rejected plaintiffs' claims that the Department's trust decision violated the IRA, the Indian Gaming Regulatory Act, the Clean Air Act, and the Administrative Procedure Act. The court viewed the same extensive record and afforded the appropriate measure of deference to the Department's supportable judgments and concluded that its decisions were reasonable and consistent with applicable law.
