Plaintiffs brought an action against the City of Oklahoma City alleging they suffered damages from a sewer backup. The jury returned a verdict for plaintiffs. The district court reduced the jury award to each couple to $25,000.00 for property damages. Plaintiffs appealed and the Court of Civil Appeals affirmed the judgment of the trial court. Plaintiffs appealed and asserted they were entitled to an additional amount per couple as awarded by the jury. The City argued a notice of claim had to specify with particularity property damages and other damages. The judge's decision in reducing the verdict was based upon two concepts: (1) a plaintiff must specify whether damages have occurred to (a) property or (b) "any other loss" as part of the pre-suit notice to the governmental entity, and (2) the absence of such specificity in the notice invalidates the notice as to either type of loss not specifically named with particularity in the notice. After review, the Oklahoma Supreme Court held a claimant's notice of "property damage" without stating "any other loss" in the notice was a sufficient notice for property damage but not sufficient notice for any other loss. The Court held plaintiffs' GTCA notices of claim using the form provided by the City of Oklahoma City and claiming specific damage to their property were also required by the GTCA to provide notice of a claim for personal injuries (or "any other loss") arising from that same transaction or occurrence in order to bring their subsequent suit in District Court for both property damage and personal injury/nuisance. The Court's holding was prospective. The opinion of the Court of Civil Appeals was vacated, the judgment of the District Court was reversed, and the matter was remanded with directions to grant plaintiffs a new trial on both their property and personal injury claims. The Supreme Court affirmed the decision of the Board of Tax Appeals (BTA) that valued the land underlying the North Bank Condominiums in Franklin County for tax year 2013. The BTA adopted the value found in an appraisal report submitted by the Columbus City Schools Board of Education (BOE). The unit owners appealed, arguing that the BTA should have adopted the land value in their appraisal report rather than the higher value in the BOE’s appraisal report. The Supreme Court affirmed, holding that the BTA did not abuse its discretion in finding the BOE’s appraisal to be more probative and in thus adopting the land value found in the BOE’s appraisal. The Supreme Court affirmed the orders issued by the Public Utilities Commission of Ohio (PUCO) finding that the presence of stray gas near Appellants’ properties created a verifiable safety hazard that justified Columbia Gas of Ohio, Inc.’s discontinuing gas service to the homes. Specifically, the court held (1) Appellants’ argument that PUCO misinterpreted Ohio Rev. Code 4905.20 and 4905.21 by permitting Columbia Gas to withdraw natural-gas service without filing an abandonment application was unavailing; and (2) PUCO did not err in determining that Columbia Gas did not violate Ohio Rev. There was no error in the determination of the Public Utilities Commission of Ohio that the plan of the Illuminating Company to remove a silver maple tree located near the company’s transmission line was reasonable. The tree belonged to Mary-Martha and Dennis Corrigan and stood within the company’s easement running through the Corrigan’s property. The Corrigans appealed, arguing primarily that the evidence did not support findings that pruning was impracticable and that the tree posed a threat to the line. The Supreme Court rejected the Corrigans’ evidentiary challenges, holding that the Corrigans failed to show that the Commission’s decision was unlawful or unreasonable. View "Corrigan v. The City of Selma ("the City") filed a petition for a writ of mandamus requesting the Alabama Supreme Court direct the Dallas Circuit Court to enter a summary judgment in its favor, based on State-agent immunity, as to claims Gregory Pettaway filed against it. Pettaway financed the purchase of a 2006 Nissan Armada sport-utility vehicle. Subsequently, Santander Consumer USA, Inc. ("Santander"), took over the loan. Santander contracted with Par North America, Inc. ("Par"), to handle repossessions for it and that Par used Central Alabama Recovery Systems ("CARS") to carry out the actual repossessions. Early on November morning in 2010, two men from CARS came to Pettaway's residence and told him that they were there to repossess the vehicle. By the time Pettaway got dressed and walked outside, the men had already hooked the Armada up to the tow truck and lifted it. Pettaway objected and telephoned the Selma Police Department; Officer Jonathan Fank responded to the call. After Officer Fank told Pettaway that the repossession was a civil matter and that he could not do anything because the vehicle was already hooked up to the tow truck, Pettaway again called the Selma Police Department to ask that Officer Fank's supervisor come to the scene. Pettaway filed a complaint against Santander, Par, CARS, and the City, alleging conversion, negligence, wantonness, and trespass claims. Although he stated conversion, negligence, wantonness, and trespass claims, Pettaway admitted that his only complaint against the City was that the officers told the repossession men to take the vehicle. The City admitted that officers were called to the scene at Pettaway's request to keep the peace but denied the remaining allegations as to the actions of its officers, raising the affirmative defense of immunity. The City argued the trial court erred in denying its motion for a summary judgment: at the time of the incident that formed the basis for Pettaway's complaint, Officers Fank and Calhoun were performing discretionary functions within the line and scope of their law-enforcement duties and that, therefore, they would be entitled to State-agent immunity. The Supreme Court concluded the City established that it has a clear legal right to a summary judgment in its favor based on State-agent immunity. View "Ex parte The City of Selma." on Justia Law

Landowners from the Buffalo area appealed a district court judgment affirming the Department of Health's decision to issue Rolling Green Family Farms an animal feeding operation (AFO) permit. The landowners argued the Department erred by issuing Rolling Green an AFO permit and by failing to reopen the public comment period after Rolling Green provided further information to supplement its permit application. Hosford, severely disabled and wheelchair-bound, has muscle spasms and pain.Since 1989, Hosford has resided at Foghorn's Baltimore CIty Ruscombe Gardens Apartments, subsidized through a federal “Section 8” project-based program. Hosford signed a “Drug-Free Housing Policy” with his lease. In 2014, the complex had a bed bug infestation. An extermination company entered Hosford’s unit and saw a marijuana plant growing in his bathtub. They reported this to the management office. A responding police officer concluded the plant was marijuana, confiscated it, and issued a criminal citation. A police chemist concluded that the plant was marijuana. A nolle prosequi was entered on the possession charge. Foghorn gave Hosford a notice of lease termination. When he did not vacate, Foghorn initiated an eviction. The Court of Appeals held that Maryland Code, Real Property 8-402.1(b)(1), which provides that a court ruling on a landlord-tenant dispute must conclude that a breach of a lease is “substantial and warrants an eviction” before granting judgment for possession of the leased premises, is not preempted by federal regulations mandating that subsidized Section 8 project-based housing developments include lease provisions that engaging in any drug-related criminal activity on or near the leased premises is grounds for termination of the lease. This case concerned the Douglas County Planning and Zoning Administrator’s grant of a building permit for a hog confinement unit. Landowners applied for a writ of mandamus compelling the Administrator and the Douglas County Planning and Zoning Commission to comply with the county’s zoning ordinance revoking the permit. After a trial, the circuit court denied Landowners’ request, concluding (1) the hog barn did not fall under any of the permitted uses of land for which a building permit could be granted; but (2) a writ of mandamus could not be used to undo an already completed act, and principles of equity would not entitle Landowners to relief. The Supreme Court ultimately affirmed the circuit court’s decision denying Landowners a writ of mandamus, holding (1) the circuit court erred in determining that the facility was not a permitted use under the ordinances; but (2) because construction of the facility had already been completed at the time of trial, issuing a writ a mandamus to revoke the permit now would be ineffective. As unclaimed property has become Delaware’s third-largest source of revenue, companies have filed lawsuits challenging the constitutionality of Delaware’s escheat regime. Plains All American Pipeline attacked the constitutionality of several provisions of the Delaware Escheats Law, which provides that a holder of “property presumed abandoned” must file a yearly report with the State Escheator in which it provides information about the property and its possible owner (Del. Code tit. 12, sects. 1142, 1143) and Delaware’s demand that it submit to an abandoned property audit. Because Plains brought suit before Delaware assessed liability based on its audit or sought a subpoena to make its audit-related document requests enforceable, the district court dismissed the suit, finding that the claims were unripe except for an equal protection claim that it dismissed for failure to state a claim. The Third Circuit reversed in part, finding an as-applied, procedural due process claim ripe, but otherwise affirmed. To establish a due process violation, all Plains must show is that it was required to submit a dispute to a self-interested party. The Supreme Judicial Court vacated the judgment of the superior court affirming the Cape Elizabeth Code Enforcement Officer’s (CEO) issuance of a building permit, holding that the CEO’s decision granting the permit lacked sufficient factual findings to permit meaningful review.The owner of property abutting the property at issue appealed the CEO’s grant of the building permit to the Town Zoning Board of Appeals (ZBA). The ZBA affirmed the CEO’s decision. The superior court affirmed. The Supreme Judicial Court vacated the superior court’s judgment and remanded the matter, holding that the COE’s grant of the building permit was the operative decision and that decision lacked sufficient factual findings to permit meaningful appellate review.
