Clam Lake Township v. Dept. of Licensing & Reg. Affairs
In Docket No. 151800, Clam Lake Township and Haring Charter Township (the Townships) appealed the determination of the State Boundary Commission (the Commission) that an agreement entered into under the Intergovernmental Conditional Transfer of Property by Contract Act (Act 425 agreement) between the Townships was invalid. In Docket No. 153008, as the Commission proceedings in Docket No. 151800 were ongoing, TeriDee, LLC brought an action against the Townships, seeking a declaratory judgment that the Act 425 agreement was void as against public policy because it contracted away Haring’s zoning authority by obligating Haring’s zoning board to rezone pursuant to the agreement. The Act 425 agreement at issue here sought to transfer to Haring Charter Township an undeveloped parcel of roughly 241 acres of land in Clam Lake Township that was zoned for forest-recreational use. The agreement provided a description of the Townships’ desired economic development project, including numerous minimum requirements for rezoning the property. Approximately 141 acres of the land were owned by TeriDee LLC, the John F. Koetje Trust, and the Delia Koetje Trust (collectively, TeriDee), who wished to develop the land for commercial use. To achieve this goal, TeriDee petitioned the Commission to have the land annexed by the city of Cadillac. The Commission found TeriDee’s petition legally sufficient and concluded that the Townships’ Act 425 agreement was invalid because it was created solely as a means to bar the annexation and not as a means of promoting economic development. The Townships appealed the decision in the circuit court, and the court upheld the Commission’s determination, concluding that the Commission had the power to determine the validity of an Act 425 agreement. The Townships sought leave to appeal in the Court of Appeals, which the Court of Appeals denied in an unpublished order. The Michigan Supreme Court held: (1) the State Boundary Commission did not have the authority to determine the validity of the Act 425 agreement and could only find whether an agreement was "in effect"; and (2) an Act 425 agreement can include requirements that a party enact particular zoning ordinances, and the Court of Appeals erred by concluding to the contrary. Clarksville Residents Against Mortuary Defense Fund, Inc. v. Donaldson Properties
The circuit court and Court of Special Appeals affirmed the decision of the Howard County Board of Appeals approving a conditional use application for a funeral home in Howard County’s Rural Residential-Density Exchange Option zone. The Howard County Board of Appeals hearing examiner initially denied the proposed conditional use plan, but after public hearings and two revisions, the Board approved the conditional use application subject to several conditions. The Court of Appeals affirmed, holding (1) the Board properly analyzed the revised plan pursuant to the relevant statutory requirements; (2) the Board did not err in concluding that the revised plan would not create an adverse cultural impact on vicinal properties or that such impact will be beyond those ordinarily associated with funeral home and mortuary uses; and (3) substantial evidence supported the Board’s conclusion that the revised plan contemplated a 100-foot stream buffer in compliance with state requirements. Terraza 8, LLC v. Franklin County Board of Revision
The amendment to Ohio Rev. Code 5713.03 enacted in 2012 (H.B. 487) applied to the circumstances of this case and required a remand to the Board of Tax Appeals (BTA) for further consideration.At issue here was a 2013 real property valuation for a lease-encumbered property that had been the subject of recent arm’s-length sales. The Supreme Court held that the H.B. 487 amendment required the BTA to determine the value of the subject property’s unencumbered fee-simple estate. Because the BTA did not properly consider appraisal evidence that purported to explain why the subject property’s recent sale price did not reflect the value of the unencumbered fee-simple estate, the court vacated the BTA’s decision and remanded the case for the BTA to address and weigh the evidence before it. Brenmor Properties, LLC v. Planning & Zoning Commission of Town of Lisbon
Plaintiff, a developer, appealed a decision of Defendant, a planning and zoning commission, denied Plaintiff’s application for an affordable housing subdivision pursuant to the Affordable Housing Appeals Act, Conn. Gen. Stat. 8-30g. The trial court sustained Plaintiff’s administrative appeal. The Appellate Court affirmed. The Supreme Court affirmed, holding (1) the commission was required to grant Plaintiff’s application for subdivision approval despite the application’s lack of compliance with a municipal road ordinance; and (2) the trial court properly ordered the commission to approve Plaintiff’s application “as is” rather than for consideration of conditions of approval. Moose Hollow Holdings, LLC v. Teton County Board of County Commissioners
Appellants owned residential property in Teton County. JCFT Wyoming Real Estate, LLC owned two parcels in the same area. The Teton County planning director, at Appellants’ request, issued a formal rule interpretation concerning a development permit associated with the JCFT property. At JCFT’s request, the planning director issued a zoning compliance verification (ZCV) concerning JCFT’s smaller parcel. Appellants appealed the rule interpretation and the ZCV decision. The Teton County Board of County Commissioners dismissed the appeals, concluding that Appellants lacked standing to appeal either action. The district court affirmed. The Supreme Court affirmed, holding (1) Appellants lacked standing to challenge the Teton County planning director’s rule interpretation and ZCV decision; and (2) neither decision was ripe for judicial review. Downingtown Borough (Friends of Kardon Park, Aplts)
In consolidated cross-appeals, the Pennsylvania Supreme Court accepted review to consider whether three statutory provisions, the “Donated or Dedicated Property Act” (“DDPA”), the “Project 70 Land Acquisition and Borrowing Act” (“Project 70 Act”), and the Eminent Domain Code, allow Appellant Downingtown Borough (“Borough”) to sell four parcels of land to private housing developers , Appellants Progressive Housing Ventures, LLC and J. Loew and Associates, Inc. (“Developers”). The four parcels comprised a public community park owned and maintained by the Borough, and were held by the Borough as trustee. After review, the Court vacated the order of the Commonwealth Court with respect to the Borough’s proposed sale to Developers of two southern parcels, reversed the order regarding the proposed sale by the Borough to Developers of two northern parcels, and reversed the order of the Commonwealth Court involving the Borough’s grant of easements to Developers over all parcels. The Borough was required to obtain court approval before selling the parcels, and easements over the land would have subordinated public rights to the parcels to private rights. West Carrollton City Schools Board of Education v. Montgomery County Board of Revision
West Carrollton City Schools Board of Education (BOE) appealed the decision of the Board of Tax Appeals (BTA) that retained the auditor’s update-year valuation of $4,716,690 for 2011 for the two contiguous parcels of property at issue in this case. Specifically, the BOE argued, inter alia, that the BTA acted unreasonably and unlawfully by refusing either to rely on the land-sale price and actual-cost evidence to value to the property. The Supreme Court affirmed, holding (1) Ohio Rev. Code barred the direct use of the land-sale price in Carmax Auto Superstores, Inc.’s 2008 acquisition of the property because Carmax spent more than $7 million on subsequently added improvements; and (2) neither the 2008 land-sale price nor the actual construction costs affirmatively negated the auditor’s valuation, and therefore, the BTA acquired no duty to perform an independent valuation. Gallegos Family Properties, LLC v. Colorado Groundwater Commission
The Colorado Supreme Court’s decision in this matter addressed appeals from two related cases: Gallegos Family Properties, LLC’s petition to de-designate a portion of the Upper Crow Creek Designated Ground Water Basin, and an order awarding the Well Owners a portion of their litigation costs. At issue was whether Gallegos satisfied the statutory standard for de-designating a portion of the Basin set forth in section 37-90-106(1)(a), C.R.S. (2003), and as interpreted by this the Court in Gallegos v. Colorado Ground Water Commission, 147 P.3d 20 (Colo. 2006), and whether Gallegos should have bourne the Well Owners’ costs. The designated groundwater court concluded that Gallegos had failed to make new showings sufficient to justify de-designating a portion of the Basin and taxed Gallegos for a portion of the Well Owners’ costs. The Supreme Court concluded that Gallegos failed to prove by evidence not before the 1987 Commission that the Well Owners were pumping water connected to Crow Creek such that future conditions and factual data justify de-designating a portion of the Basin. Because a party must show connectivity to prove impact, Gallegos failed to meet its burden, and de-designation was improper. Accordingly, the Court affirmed the designated groundwater court’s order denying Gallegos’s petition. Furthermore, because the designated groundwater court properly denied Gallegos’s petition for de-designation, the Supreme Court concluded that the court did not abuse its discretion in concluding that the Well Owners were prevailing parties for purposes of C.R.C.P. 54(d), that the costs awarded were reasonable and necessary, and that Gallegos should pay these costs pursuant to Rule 54(d). Dialysis Centers of Dayton, LLC v. Testa
The Board of Tax Appeals (BTA) upheld the tax commissioner’s denial of a property tax exemption for Appellant’s four dialysis-service centers for tax year 2007 and the denial of Appellant’s requested remission of the property taxes it paid for those facilities for tax year 2006. The Supreme Court affirmed the decision of the BTA as to tax year 2006 and reversed it as to tax year 2007, holding that remission was properly denied for tax year 2006, but for tax year 2007, Appellant’s use of space at the four centers qualified for exemption. Because some of the space listed in the facilities was leased to private physicians, the properties should be split-listed, with a portion taxable and the dialysis-service facilities exempt. United States v. Gila Valley Irrigation District
The district court entered a consent decree in 1935, known as the Globe Equity Decree, to govern the distribution of water among the Community, the Tribe, and various other landowners. In 2017, the Community, the San Carlos Irrigation and Drainage District, the United States and thousands of individual landowners entered into the Upper Valley Forbearance Agreement providing that the individual landowners could sever and transfer certain water rights. Pursuant to the Agreement, in 2008, 59 sever and transfer applications were filed by Freeport. After addressing various jurisdictional issues, the Ninth Circuit held that Freeport failed to meet its prima facie burden of demonstrating no injury to other Decree parties; the district court did not abuse its discretion by denying Freeport's motion under FRCP 15(b)(1) to amend its applications to conform to the revised maps it filed during discovery; the district court's holding that Arizona water law contained an almost identical rule prior to the 1995 amendment was foreclosed by the Arizona Supreme Court's holding in San Carlos Apache Tribe v. Superior Court ex rel. Cty of Maricopa, 972 P.2d 179, 187, 204; and the district court did not clearly err by finding that Freeport had abandoned its water rights at issue in Application 147. Accordingly, the panel affirmed the district court's September 4, 2014, order in part, dismissed in part, reversed in part, and remanded. View "United States v.
