DirecTV, Inc. v. Town of New Hampton
Plaintiff DirecTV, Inc. appealed a superior court decision denying a petition for property tax abatement for the tax years 2007, 2008, and 2009. The property at issue was located in New Hampton and used by DirecTV as a satellite uplink facility. On appeal, DirecTV argued that the trial court erred when it: (1) ruled that satellite antennas and batteries used to provide backup power constituted fixtures; and (2) determined the value of the property. The New Hampshire Supreme Court concluded after review that the antennas and batteries were not fixtures, and therefore, taxable as real estate. The Court reversed the superior court on that issue, vacated its decision on the valuation of the property, and remanded for further proceedings. View "DirecTV, Inc. v. Kutzke v. City of San Diego
Property owners Carolyn Kutzke and Karen Kapp applied to the City of San Diego (City) for a vesting tentative parcel map and related permits to allow them to subdivide two adjacent lots totaling 1.45 acres (property) into four lots, retain an existing residence on one lot, and build a new residence on each of the remaining lots (project). The local community planning board recommended denial of the project; however, the planning commission approved it and certified a mitigated negative declaration for it. A citizen appealed the planning commission's decision to the City council. The City council granted the appeal and reversed the planning commission's decision, finding the project's mitigated negative declaration was inadequate, particularly as to the project's potential impacts on geology, land use, and public safety; the project was inconsistent with the applicable community plan; and requested deviations from applicable development regulations were inappropriate for the project's location and would not result in a more desirable project. The owners petitioned the Court of Appeal for mandamus relief from the superior court order reversing the City’s decision. The Court of Appeal reversed the superior court, finding substantial evidence to support the City’s findings. View "Kutzke v. City of San Diego" on Justia Law
Ada Co Hwy Dist v. Brooke View, Inc.
The Ada County Highway District (“ACHD”) appealed a district court judgment awarding $148,390.21 plus prejudgment interest and attorney’s fees to Brooke View, Inc. d/b/a The Senator (“Brooke View”) as just compensation for a parcel of property that ACHD condemned and took possession of under the State’s eminent domain powers. ACHD argued on appeal that the district court misconstrued the law when it allowed Brooke View to recover the cost to repair damage to a wall on Brooke View’s property, which the jury found had been caused by the construction of improvements on the taken parcel. After review, the Idaho Supreme Court found the district court erred in instructing the jury on "just compensation," and those instructions prejudiced ACHD. Furthermore, the Court found the district court erred in admitting certain evidence on events, activities and damages that occurred during construction of improvements on the property. Cossette v. Cass County Joint Water Resource District
An action for equitable relief generally cannot be combined with a statutory appeal seeking a review of a local governing body's decision. Donald Cossette and the Angela R. Cossette Revocable Living Trust appealed a district court order dismissing their complaint against the Cass County Joint Water Resource District. The District passed a resolution of necessity determining the Cossettes' property was necessary for the Diversion Project and the District intended "to acquire a Permanent Right of Way Easement over, across, and through the [Cossettes'] Property." The Cossettes sought a declaration that the District inappropriately passed the resolution, and appealed from the District's resolution of necessity relating to the District's intent to acquire an interest in the Cossettes' real property through eminent domain. The North Dakota Supreme Court affirmed that part of the district court order dismissing the Cossettes' request for declaratory relief. The Court reversed that part of the district court order concluding the Cossettes were not entitled to appeal the District's resolution of necessity, and remanded. View "Cossette v. Fullbright v. Spinnaker Resorts
The South Carolina Supreme Court answered two certified questions of South Carolina law, posed by the U.S. District Court for the District of South Carolina. These questions arose from two sets of litigation (“Fullbright” and “Chenard”) at the federal district court involving individuals (collectively, Plaintiffs) who entered into contracts with developers (collectively, Defendants) to purchase interests in vacation time sharing plans (timeshare plans) for real estate on Hilton Head Island. The federal court asked the Supreme Court whether: (1) the South Carolina Real Estate Commission had exclusive jurisdiction to determine whether there was a violation of the state Vacation Time Sharing Plans Act; (2) whether the Commission’s determination of a violation of the Timeshare Act was a condition precedent to a purchaser suing to enforce the Act; and (3) whether the Commission’s determinations as to whether the Timeshare Act was violated was binding on courts. The Supreme Court answered the first two questions in the negative; the Court answered the third question “no” too, provided the Commission’s decision had not bee subjected to judicial review. Hardesty v. State Mining & Geology Board
Substantively, in three somewhat interconnected claims, Joe and Yvette Hardesty (collectively, Hardesty) attacked State Mining and Geology Board (Board) findings, contending the trial court misunderstood the legal force of his 19th century federal mining patents. He asserted he had a vested right to surface mine after the passage of SMARA without the need to prove he was surface mining on SMARA’s operative date of January 1, 1976. He argued the Board and trial court misapplied the law of nonconforming uses in finding Hardesty had no vested right, and separately misapplied the law in finding that his predecessors abandoned any right to mine. These contentions turned on legal disputes about the SMARA grandfather clause and the force of federal mining patents. Procedurally, Hardesty alleged the Board’s findings did not “bridge the gap” between the raw evidence and the administrative findings. Hardesty also challenged the fairness of the administrative process itself, alleging that purported ex parte communications by the Board’s executive director, Stephen Testa, tainted the proceedings. The Court of Appeal reviewed the facts, and found they undermined Hardesty’s claims: the fact that mines were worked on the property years ago does not necessarily mean any surface or other mining existed when SMARA took effect, such that any right to surface mine was grandfathered. However, the Court agreed with the trial court’s conclusions that, on this record, neither of these procedural claims proved persuasive. Armstrong-Trotwood, LLC v. State Tax Commission of Missouri
Appellants, who owned residential property located entirely in St. Louis County, argued that Jefferson and Franklin counties systematically undervalued property in those counties, causing Appellants to bear a disproportionate share of the cost of operating multi-county taxing districts. After exhausting their administrative remedies, Appellants filed a petition in the circuit court challenging their 2011-12 property tax assessments. The circuit court dismissed the petition for failing to state a claim upon which relief can be granted. The Supreme Court affirmed the dismissal of Appellants’ administrative claims for review and their claim for declaratory relief, holding (1) Appellants failed to assert a violation of the uniformity clause in article X, section 3 of the Missouri Constitution; and (2) the State Tax Commission lacked jurisdiction to hear Appellants’ claims of inter-county discrimination on appeal from the St. Louis County Board of Equalization. Sikora v. City of Rawlins
Clare Sikora filed a declaratory judgment action against the City of Rawlins challenging the City’s issuance of a building permit to her next-door neighbors, Jared and Kasandra Ramsey. The district court ruled in favor of the City. The Supreme Court affirmed, holding (1) the district court properly found that Sikora failed to exhaust her administrative remedies; and (2) the district court did not err in finding that the the municipal ordinance governing restoration of a nonconforming building allows for demolition of the nonconforming building and reconstruction of the building within the same footprint - the type of construction undertaken by the Ramseys. DLT List, LLC v. M7VEN Supportive Housing & Development Group
Appellee M7VEN Supportive Housing and Development Group (“M7”) failed to pay taxes on two properties in Carroll County, and, consequently, the Tax Commissioner conducted a tax sale. The properties were purchased by Appellant DLT List, LLC (“DLT”), for a total of $110,000, and the tax sale resulted in excess funds of approximately $105,000. The Commissioner notified M7, DLT, and others of excess funds, and, M7 filed a certificate of authorization seeking to receive the excess funds. Though there were no other claims made on the funds, the Commissioner did not release the funds. Appellee Design Acquisition, LLC, as a lienholder against M7, redeemed the properties from DLT, and DLT issued quitclaim deeds of redemption to M7. Design Acquisition filed a declaratory judgment action claiming entitlement to the excess funds, and the Commissioner filed an equitable interpleader action for the purpose of distributing the excess funds. The two actions were consolidated. The trial court determined that, because M7 was the only entity to have made a claim for the excess funds or to have had a recorded interest in the properties at the time of the tax sale, the Commissioner should have timely released the excess funds to M7. DLT and Design Acquisition appealed, arguing that Design Acquisition had first priority to the excess funds as the redeeming creditor. The Court of Appeals overruled the controlling case law in this matter, applied OCGA 48-4-5 (a) to the question of excess funds and determined that Design Acquisition had no claim to the excess funds because it was not a lienholder at the time of the tax sale. The Georgia Supreme Court granted certiorari to consider whether a redeeming creditor after a tax sale has a first priority claim on excess tax-sale funds. Though the Court disagreed with the rationale employed by the Court of Appeals, the Supreme Court nevertheless affirmed its decision. View "DLT List, LLC v. Select Energy Servs., LLC v. K-LOW, LLC
Select Energy Services, LLC, wanted to run a water pipeline across an old, partly destroyed irrigation ditch alongside the South Platte River. An easement arising from a water right long associated with that ditch stood in its way. K-LOW, LLC owned the easement, and attempted to block Select’s pipeline as a trespass. Yet, because the water right supporting the easement recently changed, K-LOW’s easement might no longer exist. Whether the easement existed turned on the scope of the underlying water right. Absent that water right, K-LOW’s trespass claim failed. The water court found no right to divert water from the ditch, and the Colorado Supreme Court agreed with its determination. Because, by its plain language, the decree defining the water right allowed its holder to divert water only at the pump downriver from the disputed ditch, the Court concluded the decree did not include a right to divert water from that ditch.
