Arnold v. City of Stanley
At issue in this appeal was whether the Stanley City Council erred in denying a building permit application submitted by Thomas and Rebecca Arnold. The Arnolds own property in Stanley. From 2009 to 2011, the Arnolds and the City of Stanley were involved in litigation concerning certain building permits related to the Property. The litigation resulted in a settlement agreement, which provided that the City would reissue a previously approved building permit. The Arnolds proffered several arguments on appeal asserting that the Council erred in denying their building permit application; however, the Idaho Supreme Court did not address those arguments because the Council’s denial of the building permit application was not subject to judicial review. Boardman Acquisition LLC v. Dept. of Rev.
This case involved ad valorem property taxes: the land at issue had been exempted from some property taxes because it was specially assessed as nonexclusive farm use zone farmland. When that special assessment ends, the property ordinarily has an additional tax levied against it. The question here was whether an exception created by ORS 308A.709(5) applied to excuse the payment of that additional tax. The Tax Court agreed with the Department of Revenue and concluded that the exception was not available. The Port of Morrow appealed. The Oregon Supreme Court concluded that the statutory text on which this case turned, “the date the disqualification [from special assessment] is taken into account on the assessment and tax roll,” meant the date the disqualification became effective on the assessment and tax roll. Long v. City of Helen
After the Merle and Lesia Long and their business Water Park Properties, LLC dismissed their most recent lawsuit against the City of Helen with prejudice, the trial court awarded more than $17,000 to the City for attorney fees and litigation expenses pursuant to OCGA 9-15-14. The Longs and Water Park appealed, contending that the award of fees and expenses was improper because those fees and expenses actually were borne by the City’s insurer, not the City itself. County of Douglas v. Nebraska Tax Equalization & Review Commission
At issue in this case was the adjustment of the valuation of three subclasses of residential real property in Douglas County. The Tax Equalization and Review Commission (TERC) issued an order to show cause why it should not increase the valuation of two properties by seven percent and decrease the valuation of a third property by eight percent. TERC voted to adjust the valuations. Douglas County filed a motion to reconsider, which the TERC commissioners overruled. The Supreme Court affirmed in part and reversed in part, holding (1) TERC’s order to decrease the valuation of one property by eight percent was not supported by competent evidence and was arbitrary, capricious, and unreasonable; (2) TERC’s order to increase the valuation of the other two properties was supported by competent evidence and was not arbitrary, capricious, and unreasonable; and (3) TERC did not abuse its discretion by denying Douglas County’s motion to reconsider its order. Fletcher v. United States
Plaintiffs-Appellants, a certified class of Osage tribal members who owned headrights, appealed the district court’s accounting order. Plaintiffs alleged that the government was improperly distributing royalties to non-Osage tribal members, which diluted the royalties for the Osage tribal members, the rightful headright owners. The complaint attributed this misdistribution to the government’s mismanagement of the trust assets and the government’s failure to perform an accounting. Thus, Plaintiffs sought to compel the government to perform an accounting and to prospectively restrict royalty payments to Osage tribal members and their heirs. The district court dismissed Plaintiffs’ accounting claim because it found that the applicable statute only required the government to account for deposits, not withdrawals, and that such an accounting would not support Plaintiffs’ misdistribution claim. After review, the Tenth Circuit could not say the district court abused its discretion. Groveport Madison Local Schools Bd. of Education v. Franklin County Board of Revision
The former owner of the subject property at issue in this case filed a valuation complaint in 2006 seeking to reduce the property’s tax-year-2005 value. The Franklin County Board of Revision (BOR) lowered the value but failed to send that notice to the Groveport Madison Local Schools Board of Education (BOE) at the time. When no appeal was timely filed, a refund was issued to a prior owner, and the case was closed. NSCO International Investment, LLC subsequently acquired the property. More than four years later, the BOE appealed, citing its lack of notice as the reason for its delay. The BOR made no effort to notify NSCO of the appeal. The Board of Tax Appeals (BTA) reinstated the auditor’s valuation. Two years after the BTA decision, NSCO asked the BTA to vacate its decision and schedule a new hearing because it had not been given notice or an opportunity to be heard. the BTA denied NSCO’s motion to vacate. The Supreme Court affirmed, holding (1) the BTA lacked jurisdiction to vacate its decision after the time to appeal that decision had passed; and (2) the BTA complied with Ohio Rev. Citizens for Beach Rights v. City of San Diego
In 2006, the City of San Diego (City) obtained a Site Development Permit (SDP) to construct a new lifeguard station on Mission Beach. The SDP stated that failure to utilize the permit within 36 months of its issuance would automatically void the permit. Over the ensuing years, the City worked to secure a permit from the California Coastal Commission (Commission) and to obtain funding for the project. Largely because of the economic downtown, the City struggled to find financing for the project and no construction occurred until 2015. At that time, the City notified nearby residents that its contractor would begin construction in March. The City issued building permits in April and its contractor began initial work on the project, then stopped before the summer moratorium on beach construction. In August 2015, before the end of the moratorium, Citizens for Beach Rights (Citizens) brought a petition for writ of mandate and claim for declaratory relief seeking to halt construction on the grounds that the SDP issued in 2006 had expired. The trial court agreed with Citizens and issued a permanent injunction, preventing further construction without a new SDP. The City appealed, arguing Citizens' claims were barred by the applicable statutes of limitations or the doctrine of laches and, even if the action was not time barred, the SDP remained valid in 2015 under the City's municipal code and policies. The City also argued Citizens improperly sought declaratory relief. After review, the Court of Appeal held Citizens' action was barred by the applicable statutes of limitations and, even if Citizens' claims had been timely pursued, the SDP remained valid when construction began. Westover v. Cundick
Val and LaRee Westover appealed the district court’s judgment and denial of their request for writs of mandate and prohibition against Franklin County Assessor Jase Cundick. The dispute arose when the Westovers granted an easement to Rocky Mountain Power on property owned by the Westovers. Based on his office’s records, Cundick sent a letter to Rocky Mountain Power stating that the Westovers did not own the property in question. The Westovers sought a writ of mandate to require Cundick to retract the letter and a writ of prohibition to prevent him from sending such letters in the future. The district court denied the Westovers’ request for writs of mandate and prohibition after it concluded that there were other remedies available at law. On appeal, the Westovers argued the district court erred by failing to grant injunctive relief prohibiting Cundick from sending out letters concerning real estate transactions and property ownership. Although the Westovers’ complaint did not request that the district court grant injunctive relief, they argued that the district court erred because the Westovers were clearly entitled to injunctive relief under Idaho Rule of Civil Procedure 54(c). Commerce Associates, LP, et al. v. New Castle County Office of Assessment, et al.
The New Castle County Office of Assessment (“New Castle County”) valued office condominium units for real property tax purposes but failed to take into account depreciation. The Superior Court affirmed the decision of the New Castle County Board of Assessment Review (the “Board”) upholding New Castle County’s valuation. The property owner appealed, arguing that its office condominium units were over-assessed because New Castle County and the Board did not factor in the age and resulting depreciation of the units. Because Delaware law required that all relevant factors bearing on the value of a property (in its current condition) be considered, the Delaware Supreme Court reversed and required that New Castle County reassess the value of the units, taking into account the influence depreciation has on their taxable value. Manteca Unified Sch. Dist. v. Reclamation Dist. No. 17
This case involved the interpretation, and application of Water Code section 51200 and articles XIII C and XIII D of the California Constitution, as approved by California voters in 1996 as Proposition 218, and the interplay between them. Defendants and cross-complainants Reclamation District No. 17 and Governing Board of Reclamation District 17 (collectively "Reclamation") maintained levees and other reclamation works within the district’s boundaries. Plaintiff and cross-defendant Manteca Unified School District (School) owned real property within Reclamation’s boundaries. School filed an action for declaratory relief, arguing section 51200 exempted it from paying assessments to Reclamation and Proposition 218 did not confer such authority. School also sought recovery of over $299,000 previously collected by Reclamation. Reclamation answered and cross-complained for declaratory relief. The trial court found the assessments levied by Reclamation were invalid under section 51200 but denied recovery of assessment payments made during the pendency of the action and concluded School’s action was not barred by the statute of limitations. Reclamation appealed, arguing section 51200 and Proposition 218 allowed assessments against school district property unless the district could show through clear and convincing evidence that the property received no special benefit. School cross-appealed, contending the trial court erred in denying recovery for assessments paid during the pendency of the case. The Court of Appeal concluded the trial court erred in declining to apply the constitutional mandate of Proposition 218 to the statutory exemption from assessments provided by section 51200.
