The First Circuit affirmed the district court's grant of summary judgment for Defendant's and dismissing Plaintiffs' claim that the City of Fitchburg's refusal to exempt four sober houses Plaintiffs operated for recovering addicts from a legal requirement to install sprinklers in the sober houses violated the Americans with Disabilities Act (ADA) and the Fair Housing Act, holding that the district court did not err in concluding that the requested accommodation was not reasonable.Plaintiffs brought this suit under the ADA, 42 U.S.C. 12101-12213, and the Fair Housing Act, 42 U.S.C. 3601-3631, as amended by the Fair Housing Amendments Act (FHAA). The district court dismissed the suit on summary judgment, concluding that Plaintiffs failed to show that an exemption from the sprinkler requirement was either reasonable or necessary to allow recovering addicts to live in and benefit from the sober houses. The First Circuit affirmed, holding that the district court did not err in entering summary judgment on Plaintiffs' ADA and FHAA reasonable accommodation claims. View "Summers v. The 86-acre Knights Valley parcel in rural Sonoma County is zoned “Land Extensive Agriculture,” which allows wineries and tasting rooms as conditional uses. The project is a two-story, 5,500-square-foot winery building with a 17,500-square-foot wine cave, wastewater treatment, water storage facilities, fire protection facilities, and mechanical areas, covering approximately 2.4 acres. The site contains two residences and 46 acres of vineyards. The nearby area is primarily vineyards. County staff reviewed reports considering impacts on geology, groundwater, wastewater, and biological resources, and concluded that, with recommended mitigation, the project would not have a significant effect on the environment. The county approved the use permit with conditions and adopted a mitigated negative declaration under the California Environmental Quality Act (Pub. Resources Code 21000) and a mitigation monitoring program. The court of appeal upheld the approval. Opponents did not provide evidence that the project is reasonably likely to cause landslides or otherwise generate environmentally harmful releases of debris; that erosion from the project, particularly runoff from the cave spoils, will cause significant effects on Bidwell Creek and degrade the habitat for salmonids; or that the project’s groundwater use will significantly affect salmonids, groundwater supply in neighboring wells, and fire suppression. There was no substantial evidence that the winery will have a significant aesthetic impact or that there is a reasonable possibility the project, as conditioned, will significantly increase the risk of wildfires. The Tippah County Board of Supervisors abandoned a public road, then rescinded its decision a year and a half later without giving notice to the owners of the land on which the road was located. The Mississippi Supreme Court concluded that doing so violated the landowners’ due-process rights, so it affirmed the circuit court’s order voiding the recision order. View "Tippah County v. From 2007 to 2014, the parties employed significant resources in litigating “the rights of the various parties as to Nicola Road, a [Mississippi] county road that allowed the various property owners access to Highway 603.” Jourdan River Estates (JRE) prevailed in that litigation, securing much-needed access to Nicola Road for the purpose of developing its 269-acre tract of land and constructing hundreds of condominiums. “[T]he seven year delay has been costly for” JRE and Jourdan River Resort and Yacht Club, LLC (Yacht Club). In December 2011, JRE and Yacht Club sued Scott Favre, Cindy Favre, and Jefferson Parker - neighboring property owners who opposed development - for damages, asserting fifteen different causes of action. All of the causes of action were based on the allegations that defendants delayed development of the condominium complex. After years of protracted proceedings, the circuit court granted partial summary judgment in favor of defendants. In its order, the circuit court divided its analysis between JRE and Yacht Club, disposing of each cause of action by: (1) applying the statute of limitations bar; (2) finding that plaintiffs lacked standing to bring the claim; or (3) utilizing the Noerr-Pennington doctrine, which immunized defendants from tort-based liability for having petitioned the government. The trial court denied defendants’ request to apply judicial estoppel to all of the remaining claims. JRE and Yacht Club appealed the order granting summary judgment, and defendants cross-appealed regarding the court’s application of judicial estoppel. During pendency of the appeal, the Mississippi Supreme Court sua sponte requested the parties address the issue that JRE, a foreign limited liability company, was not in good standing with the Mississippi Secretary of State prior to filing its complaint. The Court found that the parties waived the issue. Thereafter, the Supreme Court affirmed the circuit court’s grant of partial summary judgment in favor of defendants, but reversed and remanded the court’s application of judicial estoppel. A Downers Grove ordinance limits the size and location of signs. Leibundguth claimed that it violated the First Amendment because its exceptions were unjustified content discrimination. The ordinance does not require permits for holiday decorations, temporary signs for personal events such as birthdays, “[n]oncommercial flags,” or political and noncommercial signs that do not exceed 12 square feet, “[m]emorial signs and tablets.” The Seventh Circuit upheld the ordinance. Leibundguth is not affected by the exceptions. Leibundguth’s problems come from the ordinance’s size and surface limits: One is painted on a wall, which is prohibited; another is too large; a third wall has two signs that vastly exceed the limit of 159 square feet for Leibundguth’s building. The signs would fare no better if they were flags or carried a political message. A limit on the size and presentation of signs is a standard time, place, and manner rule. The Supreme Court has upheld aesthetic limits that justified without reference to the content or viewpoint of speech, serve a significant government interest, and leave open ample channels for communication. The Village gathered evidence that signs painted on walls tend to deteriorate faster than other signs. Many people believe that smaller signs are preferable. Absent content or viewpoint discrimination, that aesthetic judgment supports the legislation, which leaves open ample ways to communicate. View "Leibundguth Storage & Van Service, Inc. v. The Supreme Judicial Court vacated the decision of the Land Court judge determining that the primary purpose of Plaintiff's proposed residential program for adolescent males could not be characterized as "educational" under the Dover Amendment, Mass. Gen. Laws ch. 40A, 3, second paragraph, and therefore was not exempt from certain zoning restrictions, holding that the proposed facility and its curriculum fell within the "broad and comprehensive" meaning of "educational purposes" under the Dover Amendment.Plaintiff, The McLean Hospital Corporation, sought to develop a residential life skills program for fifteen to twenty-one year old males who exhibit extreme emotional dysregulation to allow the adolescents to lead useful, productive lives. The building commissioner determined that the proposed use was educational and that Plaintiff could proceed under the Dover Amendment and its local analog, section 6.1(i) of the town of Lincoln's bylaw. The town's zoning board of appeals reversed, determining that the program was medical or therapeutic, as opposed to education. The Land Court judge upheld the determination. The Supreme Judicial Court remanded the matter for entry of a judgment in favor of Plaintiff, holding that the fact that the curriculum of the facility is not conventional does not negate the fact that the predominant purpose of the program is educational. The Authority's Mohegan Sun Arena in Wilkes-Barre holds up to 10,000 people and hosts athletic and other commercial entertainment events. The Arena is set back and fenced apart from the public road. Patrons drive on an access road, park in an Arena parking lot, and then walk on a concrete concourse to the “East Gate” and “West Gate” entrances. “All persons are welcome to express their views” at the Arena; protesters must stand within “designated area[s]” on the concourse and “[h]andouts can only be distributed from within” those areas. The designated areas are two “rectangular enclosure[s] constructed from bike racks,” next to the Gates. The policy bans protesters from using profanity or artificial voice amplification. LCA, an animal rights group wanting to protest circus events, sued under 42 U.S.C. 1983.The trial court found that the Authority was “a public governmental entity acting under color of state law” and entered a preliminary injunction that allowed up to 20 protesters to distribute literature and talk to patrons within a circumscribed section of the concourse; protesters could not block ingress or egress. LCA protested under those terms at 2016-2017 circus performances. At a subsequent trial, LCA introduced evidence that protesters in the "designated areas" attracted little attention and videos showing nonconfrontational interactions with no abnormal congestion. The Arena expressed concerns about unruly protestors and argued that the location condition minimizes congestion and security risks. The court found all three restrictions violated the First Amendment.The Third Circuit reversed in part. The concourse’s function is to facilitate pedestrian movement; a policy sensibly designed to minimize interference with that flow is not unreasonable. In its second appearance before the Georgia Supreme Court, the dispute between appellee Lowndes County Board of Tax Assessors (“the Board”) and eight partnerships which built and operated affordable housing apartment complexes (“Section 42 properties”) in Lowndes County (collectively, “Appellants”), with the help of federal and state Low Income Housing Tax Credits (“LIHTCs” or “Section 42 Tax Credits”), in connection with which they executed Land Use Restrictive Covenants. The dispute this time turned on the valuation of those tax credits when calculating ad valorem real property taxes. The Supreme Court determined the trial court had subject matter jurisdiction to decide this case, and that LIHTCs did not constitute “actual income” for purposes of OCGA 48-5-2 (3) (B) (vii) (II). Moreover, OCGA 48-5-2 (3) (B) (vii) (I) and (II) did not run afoul of the Georgia Constitution’s taxation uniformity provision. Accordingly, the Court reversed the judgment of the trial court. The Supreme Court affirmed the judgment of the court of appeals affirming the judgment of the trial court granting declaratory judgment ordering the planning commission of the city of Broadview Heights to issue a certificate of approval to Gloria Wesolowski, holding that the thirty-day time limit set forth in Ohio Rev. Code 711.09(C) applies to a city planning commission and prevailed over the municipal subdivision regulation at issue in this case.After the commission denied Wesolowski's application seeking to subdivide property Wesolowski filed an administrative appeal alleging that the commission failed to comply with section 711.09(C), which requires that the commission either approve or deny a subdivision application within thirty days after its submission. The trial court agreed and granted partial summary judgment in Wesolowski's favor. The commission appealed, arguing that section 711.09(C) does not apply to cities because the city's regulations, adopted pursuant to its home-rule powers, prevail over section 711.09(C). The court of appeals affirmed. The Supreme Court affirmed, holding (1) the time limit set forth in section 711.09(C) applies to both cities and villages; and (2) a home-rule municipality's adoption of subdivision regulations is an exercise of its police powers, and therefore, section 711.09(C) prevails over any conflicting municipal subdivision regulation. A recall petition was filed against the Mayor and three Cathlamet council members; charges stemmed from Cathlamet’s purchase of a parcel of property at 20 Butler street. The petition alleged a violation of the Washington Constitution as a gift of public funds to the seller of the Butler Street property, Bernadette Goodroe. One additional charge against one town counselor alleged violation of RCW 42.23.070(2), prohibiting municipal officials from giving or receiving gifts related to their official capacities. The Washington Supreme Court determined the charges in the recall petition was legally insufficient, because acquisition of real property is a fundamental government purpose and discretionary act that was not manifestly unreasonable under the circumstances of this case.
