Kutcha v. Arisian
Because Defendant’s signs on her property were not “advertising signs,” the trial court properly concluded that municipal regulation of the signs was outside the scope of a municipality’s zoning commission’s authority to regulate the height, size, and location of “advertising signs and billboards” under Conn. Gen. Stat. 8-2.Plaintiff, the zoning enforcement officer for the city of Milford, requested permanent injunctions ordering Defendant, a homeowner, to remove the subject signs from her property that were not in compliance with city zoning regulations and precluding her from occupying the property until she obtained certificates that she had made home improvements to her residence.The trial court denied Plaintiff’s request for the permanent injunctions. The Supreme Court affirmed, holding (1) the phrase “advertising signs” under section 8-2 means any form of public announcement intended to aid directly or indirectly in the sale of goods or services, in the promulgation of a doctrine or idea, in securing attendance, or the like; (2) Defendant’s signs were not advertising signs under section 8-2, and therefore, the trial court properly concluded that the City lacked authority to regulate Defendant’s signs; and (3) the facts did not support the “extraordinary equitable remedy” of a permanent injunction prohibiting Defendant from occupying her premises. Fink v. Municipality of Anchorage
Property Owners appealed special assessments that the Anchorage Municipal Assembly levied on their lots to pay for recently constructed road, water, and sewer improvement projects benefiting the lots. The Property Owners claimed the special assessments improperly included nearly $1 million in costs from another municipal utility project unrelated to the improvements built for the benefit of their lots. They also claimed the special assessments exceeded limits set by ordinance and that the assessed costs were disproportionate to the benefits provided by the improvements, violating municipal ordinance, charter, and state law. After review, the Alaska Supreme Court concluded the Assembly’s allocation of costs among these projects was supported by substantial evidence and that the ordinance limit the Property Owners relied on did not apply to these assessments. Furthermore, the Court concluded the Property Owners did not rebut the presumption of correctness that attached to the Assembly’s proportionality decisions. Martin v. United States
The Inholders own patented mining and homestead claims within the Santa Fe National Forest. The 2011 Las Conchas Fire caused widespread destruction of vegetation within the forest. Forest Roads 89 and 268, which the Inholders had used to access their properties, were severely damaged by subsequent flooding. The Forest Service notified them that the roads were “impassible” and that it would provide them with limited access: “a combination of driving and hiking over specific routes and under specific weather conditions.” Later, the Service sent a letter stating that “public safety would be highly threatened by use of” the roads; that it would close the roads to public access for the foreseeable future; that because of continuing terrain instability, any reconstruction would likely be destroyed by future flooding; and, even if reconstruction were possible, the Service could not justify expending public funds when there is no general public need. The Service suggested that the Inholders work “collectively” to reconstruct the roads. The Inholders claimed that they held statutorily-granted easements. The USDA disagreed, citing 90 Stat. 2743, but acknowledged that the Inholders had a right to access their properties, “subject to reasonable regulations.” The Inholders claimed a compensable taking. The Federal Circuit affirmed the Claims Court’s dismissal, finding that the Inholders had not adequately pled a physical taking and that any regulatory taking claim was not ripe because the Inholders had not applied for a permit to reconstruct the roads. Chicago Joe’s Tea Room, LLC v. Village of Broadview
In 2006 Conway contracted to sell land in Broadview to Donahue, who assigned the contract to Chicago Joe’s Tea Room, LLC. Chicago Joe’s sole manager applied for the required special-use permit. Broadview denied the application in 2007. The land sale contract never closed and the planned strip club never opened. The LLC and Conway filed suit in 2007 alleging that Broadview violated the First Amendment. Broadview amended its ordinances multiple times during the lawsuit. One amendment led District Judge Gottschall, to conclude that Broadview’s amendment to its adult-use setback ordinance was “aimed solely at Chicago Joe’s.” After the case was transferred to Judge Lee, the parties litigated renewed summary judgment motions. Judge Lee granted Broadview summary judgment on Chicago Joe’s declaratory judgment and injunction claims, but denied summary judgment on the damages claim. The Seventh Circuit concluded that the claim for injunctive relief that established interlocutory appellate jurisdiction is actually moot, and affirmed its dismissal. At every stage of the process, Chicago Joe’s has proposed a use of property prohibited by then-current local law, so it has no vested rights. Since 2007, Chicago Joe’s has proposed to use the property in a way prohibited by Illinois statute, without challenging that statute. View "Chicago Joe's Tea Room, LLC v. Orchard Hill Building Co. v. United States Army Corps of Engineers
In 1995, Orchard purchased the Warmke Parcel, 13 acres of wetlands, for residential development. Orchard requested a determination from the Army Corps of Engineers that the wetlands were not jurisdictional “waters of the United States” under the Clean Water Act, 33 U.S.C. 1251(a). Before 2015, the Corps defined waters of the United States to include waters “subject to the ebb and flow of the tide,” “rivers” that could be used for interstate recreation or commerce, “tributaries” of such waters, and “wetlands adjacent to” other waters of the United States, including tributaries. The Warmke wetlands are surrounded by residential development. The closest navigable water, Little Calumet River, is 11 miles away. In between the Warmke wetlands and Little Calumet River are man‐made ditches, sewer pipes, and Midlothian Creek—a tributary of the Little Calumet River. The Warmke wetlands drain, via sewer pipes, to Midlothian Creek. While the Warmke issue was pending, the Supreme Court decided that a wetland’s adjacency to a tributary of a navigable‐in‐fact water is alone insufficient to make the wetland a water of the United States, “the Corps’ jurisdiction over [such] wetlands depends upon the existence of a significant nexus between the wetlands in question and navigable waters in the traditional sense.” The Seventh Circuit reversed the Corps’ claim of jurisdiction, finding that the Corps has not provided substantial evidence of a significant nexus to navigable‐in‐fact waters. Archbold-Garrett v. New Orleans City
The city owned land and a townhome in New Orleans after 1998; its previous owner, Jett, neglected to pay his taxes. Notwithstanding its recorded ownership, the city instituted Code Enforcement proceedings against Jett in 2012. The Garretts purchased the property on October 2, 2015, and recorded the conveyance on October 14. They claim that the building was structurally sound. The city continued to pursue Jett. An administrative judgment was entered on October 30, ordering Jett to pay fines and warning that the building could be demolished. A lien was recorded on December 7. The Garretts were not named and received no notice. On January 15, 2016, their realtor noticed a sign advising upcoming demolition of the property. They contacted the city, which canceled the lien. E-mail exchanges indicated that the Garretts intended to resolve all code issues. On January 27, the city demolished the townhouse. Denying the Garretts' request for compensation, the city sent a bill for the demolition costs. They did not appeal but filed suit alleging denial of due process and just compensation. The district court dismissed the claim as jurisdictionally unripe because they failed to seek compensation in state court. The Fifth Circuit vacated, finding the due process claim, predicated on lack of notice and a hearing, ripe, given the uncertainty of remedies in a state court inverse condemnation suit. McLaughlin v. Zoning Board of Review of the Town of Tiverton
At issue was whether Plaintiff was entitled to relief under Rule 60(b)(6) of the Superior Court Rules of Civil Procedure from an order directing him to remove a garage from his property.In 2014, the superior court ordered Plaintiff to remove a garage he built on his property that violated the setback requirements set forth in the Town of Tiverton’s zoning ordinance. Thereafter, the Town removed the garage from Plaintiff’s property and placed a lien on the property for $69,300 in fines imposed by a 2015 contempt order. In 2016, Plaintiff filed a motion to vacate the 2014 order. The trial judge denied the motion.The Supreme Court reversed, holding (1) because the superior court possessed subject matter jurisdiction to order Plaintiff to remove his garage, and because the granting of the 2014 order did not violate due process, the order was not void; but (2) the unique circumstances of this case and its procedural flaws presented a manifest injustice justifying relief from the operation of the order under Rule 60(b)(6). Chicago Coating Co., LLC v. United States
The Surface and Transportation Board (STB) has regulatory authority over rail carriers, 49 U.S.C. 10501(b). A "discontinuance" allows a rail carrier to preserve a rail corridor for possible reactivation of service; "abandonment" removes the line from the system and terminates the railroad’s common carrier obligation. The 1983 Amendments to the National Trails System Act created an alternative process, “railbanking,” 16 U.S.C. 1241, which maintains STB jurisdiction over the dormant corridor, but allows a third party to assume responsibilities for the right-of-way, preserve the right-of-way for future rail use, and, in the interim, convert the corridor into a recreational trail. The railroad first initiates abandonment proceedings; a party interested in acquiring the corridor then requests an STB Notice of Interim Trail Use (NITU). If an agreement is reached, the STB suspends abandonment proceedings, preventing state law reversionary interests in the corridor from vesting. Property owners who believed they had a reversionary interest began claiming that railbanking constituted a taking: the threshold question is whether the claimant has a compensable property interest, which is often answered by analyzing the original deeds that conveyed the property to the railroad. In 2012, BNSF initiated proceedings to abandon a corridor. The Chicago Department of Transportation indicated interest in railbanking. The STB issued an NITU, giving BNSF until April 2014, to negotiate an agreement, after which the corridor would be abandoned. After numerous extensions, BNSF has neither reached an agreement nor abandoned the corridor. The Federal Circuit affirmed the Claims Court: the deeds between the predecessors-in-interest to the claimants and the original railroad conveyed the property to the railroad in fee simple rather than only an easement. Meyers v. JDC/Firethorne, Ltd.
The Supreme Court dismissed with prejudice a land developer’s claim against a county commissioner in his official capacity, holding that the developer did not have standing to pursue its claim for injunctive relief against the county commissioner.In its complaint, the developer sought mandamus relief requiring the county engineer to submit the developer’s completed plat application to the Fort Bend County Commissioners Court for approval. At issue in this appeal was the injunctive relief the developer sought against the commissioner, alleging that the commissioner inappropriately instructed the county engineering department to delay processing the submitted plat and construction plans. The commissioner filed a plea to the jurisdiction claiming that the developer’s suit against him in his official capacity was barred by governmental immunity. The trial court denied the plea. The court of appeals affirmed. The Supreme Court reversed, holding that because an individual county commissioner in Fort Bend County lacks legal authority to receive, process, or present a completed plat application to that county’s commissioners court for approval, the developer failed to show a substantial likelihood that the injunction it sought will remedy its alleged injury. Potter v. South Salt Lake City
The Supreme Court held that a party alleging error by a land use authority is no longer required to establish that the “decision would have been different” but for the error under the standard set forth in Springville Citizens for a Better Community v. City of Springville, 979 P.2d 332 (Utah 1999). Instead, a party can establish prejudice by showing a reasonable likelihood that the error changed the land use authority’s decision.Appellants brought this lawsuit challenging the South Salt Lake City Council’s decision to close a portion of Truman and Burton Avenues. The City Council voted to vacate both streets in response to a petition by a car dealership. The district court granted summary judgment for the City. The Supreme Court affirmed, holding that, under the revised and clarified standard set forth in this opinion, Appellants failed to identify any prejudice resulting from any alleged deficiency in the petition. In addition, the petition to vacate was valid under Utah Code 10-2a-609.5, and notice of the City Council meetings was sufficient under Utah Code 10-9a-208. View "Potter v.
