Chelan Basin Conservancy v. GBI Holding Co.
Petitioner Chelan Basin Conservancy (Conservancy) sought the removal of six acres of fill material that respondent GBI Holding Co. added to its property in 1961 to keep the formerly dry property permanently above the artificially raised seasonal water fluctuations of Lake Chelan. At issue was whether the State consented to the fill's impairment of that right and, if so, whether such consent violated the public trust doctrine. After review, the Washington Supreme Court found the Court of Appeals correctly concluded that the legislature consented to the fill's impairment of navigable waters under RCW 90.58.270 (the Savings Clause), but the Court of Appeals prematurely concluded such consent did not violate the public trust doctrine. Because the trial court never reached the highly factual public trust issue, the Court reversed and remanded to the trial court to determine in the first instance whether RCW 90.58.270 violated the public trust doctrine. Clam Lake Township v. Dept. of Licensing & Reg. Affairs
In Docket No. 151800, Clam Lake Township and Haring Charter Township (the Townships) appealed the determination of the State Boundary Commission (the Commission) that an agreement entered into under the Intergovernmental Conditional Transfer of Property by Contract Act (Act 425 agreement) between the Townships was invalid. In Docket No. 153008, as the Commission proceedings in Docket No. 151800 were ongoing, TeriDee, LLC brought an action against the Townships, seeking a declaratory judgment that the Act 425 agreement was void as against public policy because it contracted away Haring’s zoning authority by obligating Haring’s zoning board to rezone pursuant to the agreement. The Act 425 agreement at issue here sought to transfer to Haring Charter Township an undeveloped parcel of roughly 241 acres of land in Clam Lake Township that was zoned for forest-recreational use. The agreement provided a description of the Townships’ desired economic development project, including numerous minimum requirements for rezoning the property. Approximately 141 acres of the land were owned by TeriDee LLC, the John F. Koetje Trust, and the Delia Koetje Trust (collectively, TeriDee), who wished to develop the land for commercial use. To achieve this goal, TeriDee petitioned the Commission to have the land annexed by the city of Cadillac. The Commission found TeriDee’s petition legally sufficient and concluded that the Townships’ Act 425 agreement was invalid because it was created solely as a means to bar the annexation and not as a means of promoting economic development. The Townships appealed the decision in the circuit court, and the court upheld the Commission’s determination, concluding that the Commission had the power to determine the validity of an Act 425 agreement. The Townships sought leave to appeal in the Court of Appeals, which the Court of Appeals denied in an unpublished order. The Michigan Supreme Court held: (1) the State Boundary Commission did not have the authority to determine the validity of the Act 425 agreement and could only find whether an agreement was "in effect"; and (2) an Act 425 agreement can include requirements that a party enact particular zoning ordinances, and the Court of Appeals erred by concluding to the contrary. Key v. Brown University
Plaintiffs filed a complaint against Brown University and the City of Providence. In count one of their complaint Plaintiffs sought a declaration that the university’s construction of an artificial turf field hockey field with attendant bleachers, electronic scoreboard, press box, and public-address system was an unlawful use under the Providence zoning ordinance. The superior court granted summary judgment to Defendants as to count one. The Supreme Court vacated the judgment of the superior court, holding that the hearing justice erred in finding that Plaintiffs had no standing with respect to count one because, as abutting property owners, Plaintiffs clearly established an articulable injury in fact. Murr v. Wisconsin
The St. Croix River, part of the boundary between Wisconsin and Minnesota, is protected under federal, state, and local law. State and local regulations prevent the use or sale of adjacent riverside lots under common ownership as separate building sites unless they have at least one acre of land suitable for development. Petitioners’ parents purchased adjacent Troy, Wisconsin lots separately in the 1960s, and transferred one lot to petitioners in 1994 and the other to petitioners in 1995. Each lot is over one acre, but because of the topography, each has less than one acre suitable for development; common ownership barred their separate sale or development. Petitioners unsuccessfully sought variances, then filed suit, alleging a regulatory taking. The state courts and U.S. Supreme Court rejected the claims, regarding the property as a single unit in assessing the effect of the challenged governmental action. The Court noted the flexibility inherent in regulatory takings jurisprudence. Courts must consider several factors. Wisconsin’s merger provision is a legitimate exercise of state power and the valid merger of the lots under state law informs the reasonable expectation that the lots will be treated as a single property. The lots are contiguous. Their terrain and shape make it reasonable to expect their range of potential uses might be limited. Petitioners could have anticipated regulation of the property, given its location along the river, which was regulated by federal, state, and local law long before they acquired the land. The restriction is mitigated by the benefits of using the property as an integrated whole, allowing increased privacy and recreational space, plus an optimal location for any improvements. Brenmor Properties, LLC v. Planning & Zoning Commission of Town of Lisbon
Plaintiff, a developer, appealed a decision of Defendant, a planning and zoning commission, denied Plaintiff’s application for an affordable housing subdivision pursuant to the Affordable Housing Appeals Act, Conn. Gen. Stat. 8-30g. The trial court sustained Plaintiff’s administrative appeal. The Appellate Court affirmed. The Supreme Court affirmed, holding (1) the commission was required to grant Plaintiff’s application for subdivision approval despite the application’s lack of compliance with a municipal road ordinance; and (2) the trial court properly ordered the commission to approve Plaintiff’s application “as is” rather than for consideration of conditions of approval. Affordable Recovery Housing v. City of Blue Island
The Sisters own Blue Island buildings: a convent, a church, and a boarding school that closed long ago. The buildings were used as a public high school until 2009. Affordable wanted to use the buildings as a recovery home, providing lodging, meals, job training, religious outreach, and other services to adult men fighting drug or alcohol addiction. The Sisters agreed; the few remaining nuns would continue to occupy the convent and the Sisters would obtain rental income. Occupancy would prevent vandalism. With the mayor’s approval, Affordable moved 14 staff members into the buildings. The city required installation of a sprinkler system in the sleeping rooms. Affordable had already moved in 73 men without the required special‐use permit. Affordable filed suit. The court denied a preliminary injunction. The residents vacated. Four subsequently suffered fatal overdoses. Affordable obtained a recovery house license from the Illinois Department of Human Services, which does not require sprinklers in buildings fewer than four stories high. The court granted Affordable partial summary judgment on preemption grounds but rejected claims under the Illinois Religious Freedom Restoration Act that would have been entitled Affordable to damages and attorneys’ fees. The Seventh Circuit affirmed. Affordable did not argue that the sprinkler requirement would have substantially burdened its religious exercise even if it had complied. Downingtown Borough (Friends of Kardon Park, Aplts)
In consolidated cross-appeals, the Pennsylvania Supreme Court accepted review to consider whether three statutory provisions, the “Donated or Dedicated Property Act” (“DDPA”), the “Project 70 Land Acquisition and Borrowing Act” (“Project 70 Act”), and the Eminent Domain Code, allow Appellant Downingtown Borough (“Borough”) to sell four parcels of land to private housing developers , Appellants Progressive Housing Ventures, LLC and J. Loew and Associates, Inc. (“Developers”). The four parcels comprised a public community park owned and maintained by the Borough, and were held by the Borough as trustee. After review, the Court vacated the order of the Commonwealth Court with respect to the Borough’s proposed sale to Developers of two southern parcels, reversed the order regarding the proposed sale by the Borough to Developers of two northern parcels, and reversed the order of the Commonwealth Court involving the Borough’s grant of easements to Developers over all parcels. The Borough was required to obtain court approval before selling the parcels, and easements over the land would have subordinated public rights to the parcels to private rights. Statoil Oil & Gas, LP v. Abaco Energy, LLC
Statoil Oil & Gas LP appealed judgments dismissing without prejudice its actions against numerous defendants, seeking a determination of the proper distribution of oil and gas revenues from Williams and McKenzie County wells on land adjacent to the Missouri River and under Lake Sakakawea. It was undisputed that the United States claimed an interest in the property and, although the United States waived sovereign immunity regarding real property title disputes, those actions against the United States had to be brought and resolved in a federal court. The parties therefore agreed that joinder of the United States was not feasible for purposes of N.D.R.Civ.P. 19(a). The provisions of N.D.R.Civ.P. 19(b) come into play:"(b) When Joinder Is Not Feasible. If a person who is required to be joined if feasible cannot be joined, the court must determine whether, in equity and good conscience, the action should proceed among the existing parties or should be dismissed. Considering N.D.R.Civ.P. 19(b)(1), the district court noted the United States would be prejudiced to some extent by its absence in the proceedings because, although it would not be bound by a state court judgment, a judgment in favor of other mineral owners would cloud its record title to the disputed property. This could force the United States to institute a proceeding to protect its interests in the property, resulting in a waste of judicial and party resources. The trial court concluded there was a risk of substantial prejudice to the United States (including both its mineral interests and its sovereignty) if this matter proceeded in its absence, and therefore the first factor favors dismissal. The North Dakota Supreme Court affirmed, concluding the district court did not abuse its discretion in dismissing the actions because Statoil failed to join the United States as an indispensable party. Wolfram v. Town of North Haven
The Supreme Judicial Court affirmed the judgment of the superior court affirming a decision of the Town of North Haven Board of Appeals that upheld a permit issued by the Town of North Haven Planning Board to Nebo Lodge, Inc. and Nebo Real Estate, LLC. The court held (1) the North Haven Board of Appeals (BOA) did not err in interpreting various provisions in North Haven’s ordinance; and (2) the permit review process did not violate the due process rights of Steven Wolfram, who opposed the applications, because there was a dearth of evidence that the BOA decision was the product of bias or procedural unfairness. Balano v. Town of Kittery
The Supreme Judicial Court affirmed the judgment of the superior court affirming the Town of Kittery Planning Board’s approval of a site plan application for development of a hotel on Route 1. The court held (1) the Board’s finding that a pitched roof for the building was not practicable was supported by substantial evidence, and the Board was authorized to approve a flat-roof design under the circumstances; (2) regarding the height of the building, the Board did not err in its application of the zoning ordinance’s height restrictions; and (3) the Board’s decision regarding the roof design and building height did not amount to a variance.
